What's a ballpark estimate for a cash settlement for whiplash/back injury victims in CO?
Posted by MarkJan 24
I was in a rear-end collision in 2002 and still have back and neck pain from it…everything is documented and I have been in and out of physical therapy for years because the pain will go away and then come back again a few months later. It interferes with my ability to focus sometimes, and it makes sitting painful other times. What’s the average or ballpark amount of cash settlement I could receive from the insurance company for this?
The statute of limitations hasn’t run out yet in this case.

First thing you are going to need to do is check to see if the statute of limitations hasn’t run out in your state. In many states, it’s between 2-3 years. You may be too late.
EDIT: Okay good. You should probably be in contact with the insurance company for the other driver (if you aren’t already), and let them know that you are seeking compensation for your injuries. If your treatment is ongoing, they may decline to make an offer until you are released by your doctors. As for an amount, even a ballpark figure is going to be tough because all cases are judged on their own merit, and because no one here has access to all of your medical records, it’s going to be hard to even venture a guess. Just remember, you have the option of declining any offers that you think are too low and asking for more. If you feel your suffering is worth more than they are willing to give, you may have to get an attorney. Just be warned though, an attorney is not always able to get more for you, and you may end up with less because of the attorney fees. Insurance companies don’t calculate lawyer fees into their settlements, so his fees will come out of that settlement.
