I was rear-ended, with $1000 damage to bumper and a neck injury. What is a fair settlement?

I was rear-ended in May. I have been going to physical therapy approximately 3x per week for an injury to my neck. My insurance company has been paying for the physical therapy, minus a deductible and small copays. There was approximately 00 damage to my rear bumper. What would be considered a fair settlement?

With only $1,000.00 in damages to your vehicle, it sounds like a pretty low impact loss. This is not anything anyone really could answer for you because it depends on your injury history (Have you had problems before? Degeneration, etc.), and if you have been over/under treating. It sounds as if you are inquiring about the bodily injury portion which is for pain and suffering. You ought to be paid for the damages to your vehicle, the rental for the reasonable repair time for your vehicle, and your medical bills ought to be covered as well-but depending on your state, this is usually covered by your own insurance company. In most states, there is a threshold for a bodily injury claim. I would suggest you contact your own insurance company for advice concerning this because all bodily injury claims are handled on a case by case basis. There is no black and white because no two BI claims are the same. Good luck!!!!
Ask Judge JUDY!
no less than 10,000$$$ for sure!!
one answer…personal injury lawyer!
Sounds like you need an attorney. He/she will advise as to what is a proper amount for which to sue the other driver. Good luck!
I am sorry that I am not qualified to give you an exact settlement figure, as I don’t have experience with that kind of law, but please do call one of the guys you always see on TV. They specialize in this kind of cases exclusively and will give you a fair estimation. Hope that helps
that you get your car fixed and stop trying to rip off the one who hit your car. It’s a fair settlement to say you shouldn’t be monetarily compensated for this.
you need to talk to a lawyer on this one, never settle for what they offer you, also make sure there’s not going to be any long term problems from this happening, good luck on it.
get a lawyer, the insurance companies are only out for them selfs. you have to look down the road not just the present, you will have pain from the injury for life. dont sign anything dont take any sort of settlement or partial payment because when you do they are done, they do not have to pay you another dime. and dont let them say this is just for the bumper or just for medical, because it is for everything, that is why you really need a lawyer. you should be able to find one that will only charge if you get anything.
You should seek legal advice.
Your medical bills, car damage and 15%.
Well, medical payments – but in some states you aren’t even eligible for that, because you could be in a no fault or limited tort state.
You’ll have to discuss this with your agent.
TO MEL:
Why shouldn’t the guy who hit him have to pay??? The guy who hit this person’s car SHOULD have to pay, he hit him!! You can’t just go around getting into car accidents, wrecking people’s cars and hurting people and “not have to pay”. Life is all about paying consequences for your actions, a lesson that you may have not learned in life!!!!!!!!
