Can back child support be collected from an insurance settlement?
Posted by MarkJun 18
I’m owed over 26K in back child support. The sperm donor was in a motorcycle accident recently and wasn’t his fault. I’m wondering if he gets a settlement, will any of it go to settle his child support debt?
LOL! Yea, I mean the father.

Yes, I believe so.
Wages can be garnished. Future earnings can be garnished in a civil matter. So I don’t see why back child support owed wouldn’t fall into that category as well.
I’m assuming when you say "sperm donor" you mean the father and not literally a sperm donor.
Yes you can. Hopefully the state will pay you before he gets his part. I am owed 40 gs in back child support I almost feel evil for waiting for my son’s ‘co-creator’s settlement.
You need to contact the district attorneys office in charge of child support and let them know of his impending settlement. Do not assume that they will automatically know. They can then put a hold on any settlement amount he may get in order to pay you.
That’s a good name for the father of your child!
But if he has already acknowledged being the father, and has been taken to court for child support, he may very well be obligated to pay you the 26K, that’s if, the accident hasn’t left him brain dead! If he is any kind of a man, he will pay up, OR lick his wounds and take off for parts unknown! Why don’t you just ask the guy!?
